Updates

On 22 October 2026, the Federal Court delivered judgment in McCabe v Mosaic Brands Limited (In Liquidation) (Receivers and Managers Appointed) [2026] FCA 1569. A copy of the Judgement is downloadable from the Creditor Section. 

The Court found that while the directors held privilege over Safe Harbour advice, privilege had been waived in respect of advice recorded in Board minutes and certain Safe Harbour materials relating to events after 21 June 2021.

The parties are required to provide proposed orders to the Court by 5 November 2026. If required, a further case management hearing will take place on 9 November 2026. 

The SPLs will continue their investigations and provide further updates to creditors as appropriate.
